Negotiations and Contentious Matters: Language is not the only potential obstacle for a foreigner seeking to negotiate or settle a matter in Spain. Different legal and juridical systems, social styles and expectations, philosophies of life and business, and other conceptual and cultural differences all contribute to what can be an imperfect understanding between negotiating or conflicting parties.

Throughout Spanish territory, Windram Miller conducts many successful negotiations and conflict resolutions for clients. They can range from the simplest quick phone call to smooth out misunderstandings, to the most complex and difficult commercial contract negotiation.

Our philosophy in such negotiations and contentious matters is that an accurate record, made at the time, of the terms of an agreement is far better than a quick signature later regretted, and that discussion is vastly preferable to litigation. We are not litigators by preference and indeed seek to avoid such actions wherever possible. Our approach in these negotiations and contentious matters is more that of the businessman than the lawyer. Nevertheless, where litigation becomes unavoidable, we can initiate action and/or refer the matter to appropriately selected professional contacts and associates. We will provide the necessary briefing, communication, and coordination services where it is appropriate that we remain involved in a referred case. Those cases which we have directed have all - so far, at least - been successful for our clients.
